Terms & Conditions

1) Agreement

By using Opua Adventures or booking a rental (the “Services”), you accept these Terms and our Privacy Policy.

2) Eligibility & operator requirements

  • Renter must be 18+; operators must meet applicable Florida water-safety requirements and carry valid government ID.

  • Where required by law, present your boating/paddle safety certificate. We may refuse service if legal criteria aren’t met.

3) Safety rules (summary)

  • Wear a U.S. Coast Guard–approved PFD whenever required.

  • No alcohol/drugs or impaired operation.

  • Respect speed/no-wake zones; keep safe distance from swimmers, wildlife, docks, and other craft.

  • Follow staff instructions and local regulations; violations may end the rental without refund.

4) Reservations, pricing & payment

  • Prices, taxes, deposits, delivery fees, and optional add-ons are shown at checkout.

  • You authorize charges for rental fees and any post-rental amounts (fuel where applicable, late return, cleaning, damage, lost gear) per your agreement.

5) Security deposit & post-rental inspection

A refundable deposit may be held to cover incidentals. You’re responsible for damage beyond normal wear, excessive cleaning, missing gear, and late-return fees.

6) Weather & conditions

If staff deem conditions unsafe (e.g., lightning, small-craft advisories), we’ll reschedule or refund per our Refund Policy. Cloud cover or light rain alone may not qualify.

7) Equipment condition & telemetry

Inspect your craft before departure and note any issues. Where fitted, GPS/telemetry supports safety, zone compliance, and theft prevention.

8) Title & risk

Title remains with us. You assume risk of operation after the safety briefing and hand-off, except where our negligence applies under law.

9) Prohibited uses

No night operation, towing without written approval, subleasing/lending, or operating outside permitted zones.

10) Disclaimers & liability cap

Except as required by law, Services are provided “as is” and “as available.” To the maximum extent permitted, OPUA BOARD RENTALS LLC isn’t liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability won’t exceed the amounts you paid for the rental at issue.

11) Indemnity

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, unlawful conduct, or negligent operation.

12) Updates; governing law

We may update these Terms at any time; continued use constitutes acceptance. These Terms are governed by Florida law with exclusive venue in Sarasota County, Florida.
